1. ACCEPTANCE OF TERMS

By accessing Dr. Kothari’s Faster Pharmacy services through WhatsApp, our website, or any other communication channel, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. SERVICES PROVIDED

2.1 Medicine Delivery: Prescription and over-the-counter medications delivered to your doorstep.

2.2 Nurse-Led Home Services: Professional nursing services including medicine delivery, organization, and counseling.

2.3 Medical Equipment Rental: Essential medical equipment available at competitive rental rates with installation.

2.4 Teleconsultation Services: General physician consultations available through our platform.

2.5 Additional Services: Health check-ups, physiotherapy, injection services, and wellness product delivery.

3. ORDERING AND PAYMENT

3.1 Order Process: All orders must be placed through our official WhatsApp number or authorized communication channels. Prescription medications require valid prescriptions as per Indian pharmaceutical regulations.

3.2 Payment Methods: We accept UPI, credit/debit cards, and cash on delivery (COD). Payment processing may occur directly through WhatsApp payment links via WATI or through third-party payment gateways.

3.3 Pricing: All prices are inclusive of applicable taxes. Discounts are applied based on product categories and availability.

4. PRESCRIPTION REQUIREMENTS

4.1 Valid Prescription: Prescription medications require a valid prescription from a registered medical practitioner. We reserve the right to verify prescriptions with the prescribing doctor.

4.2 Prescription Storage: Prescription images are stored securely and handled in accordance with medical privacy standards.

5. RETURNS, REFUNDS, AND CANCELLATIONS

5.1 Cancellation Policy: Orders can be cancelled before dispatch by contacting our customer service. Orders marked “Out for Delivery” cannot be cancelled but can be refused at delivery.

5.2 Return Eligibility: Returns are accepted within 7 days of delivery under the following conditions:

  • Products delivered do not match your order

  • Products are damaged during transit (do not accept tampered packages)

  • Products are near expiry (less than 3 months remaining shelf life)

  • Manufacturing defects

5.3 Non-Returnable Items: The following items cannot be returned:

  • Partially used medication strips or opened bottles

  • Temperature-controlled products (vaccines, injections, insulin)

  • Expired products (post-purchase)

  • Prescription medications (unless delivered incorrectly)

5.4 Refund Process: Approved refunds will be processed within 7-10 working days through the original payment method.

6. MEDICAL EQUIPMENT RENTAL

6.1 Rental Terms: Medical equipment rental requires a minimum commitment period as specified in the rental agreement. Full rental fees apply regardless of usage duration.

6.2 Equipment Care: Customers are responsible for proper equipment handling and maintenance. Any damage beyond normal wear and tear will be charged to the customer.

6.3 Damage Liability: In case of physical damage due to negligence, customers will bear repair costs or purchase the equipment at depreciated value.

6.4 Return Process: Equipment must be returned with 30 days written notice. Late returns may incur additional charges.

7. TELECONSULTATION DISCLAIMER

7.1 Medical Disclaimer: Teleconsultation services are NOT a substitute for in-person medical consultations. Our telemedicine services are designed for routine, non-complex medical issues only.

7.2 Emergency Situations: For medical emergencies, immediately contact local emergency services or visit the nearest hospital. Do not use teleconsultation for urgent medical problems.

7.3 Limitations: Teleconsultation has inherent limitations including inability to perform physical examinations and potential technical failures. By using our teleconsultation services, you acknowledge these limitations.

7.4 Liability: We shall not be held responsible for any adverse outcomes resulting from teleconsultation services due to their inherent limitations.

8. LICENSING AND COMPLIANCE

8.1 Pharmacy License: Dr. Kothari’s Faster Pharmacy operates under valid pharmacy licenses as required by Indian regulations.

8.2 Regulatory Compliance: All operations comply with the Drugs and Cosmetics Act, 1940, and other applicable Indian pharmaceutical regulations.

9. GEOGRAPHIC COVERAGE

9.1 Current Service Area: We currently serve Thane city with plans for nationwide expansion.

9.2 Future Expansion: Service areas may be expanded at our discretion without prior notice.

10. LIMITATION OF LIABILITY

10.1 Service Limitations: We strive for accuracy but do not guarantee 100% stock availability or delivery times due to external factors.

10.2 Maximum Liability: Our maximum liability for any claim shall not exceed the amount paid for the specific service or product in question.

11. INTELLECTUAL PROPERTY

All content, trademarks, and intellectual property related to Dr. Kothari’s Faster Pharmacy remains our exclusive property.

12. GOVERNING LAW AND JURISDICTION

12.1 Applicable Law: These Terms and Conditions are governed by Indian law.

12.2 Dispute Resolution: Any disputes arising from these terms shall be subject to the exclusive jurisdiction of courts in Thane, Maharashtra.

13. MODIFICATIONS
